1. Acceptance of these terms
These Terms of Use (the “Terms”) are a binding agreement between you and SkylonTech Inc. (“SkylonTech,” “we,” “us,” or “our”) governing your use of the Sorted mobile apps, this website, and related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live, if higher) to use the Services. By using Sorted, you represent that you meet this requirement and that you are able to enter into a binding contract.
3. The Sorted service
Sorted lets you:
- create shopping lists and other lists, and keep them in sync across your devices;
- share lists with other people and edit them together in real time;
- have items sorted into categories and given icons automatically (see Automated features);
- see Insights built from what you have bought, get “Running low” reminders, and receive recipe ideas after a shopping trip; and
- subscribe to Sorted Premium for the features described in Premium subscription.
We may add, change, or remove features over time to improve the Services. We may also set reasonable limits on use (for example, how many AI requests an account can make in a minute) to keep the Services running well for everyone.
4. Your account
You use Sorted with a registered account (email and password, Google Sign-In, or Sign in with Apple). You are responsible for the activity under your account and for keeping your credentials secure. Please provide accurate information and keep it up to date. Notify us at support@skylontech.ca if you believe your account has been compromised.
If you sign up with an email address, you must verify it. Until you do, some features (such as inviting people to a list) are unavailable, and after a grace period the app becomes read-only until the address is verified.
5. Acceptable use
You agree not to:
- use the Services for any unlawful purpose or in violation of these Terms;
- invite people to lists, or share Premium with people, without a reasonable basis to believe they welcome it, or use sharing to harass, spam, or send unwanted messages;
- upload content that is illegal, infringing, harmful, or violates others’ rights;
- enter text designed to manipulate the AI features into producing abusive, harmful, or unrelated output;
- attempt to access accounts or data that are not yours, or probe, scan, or breach security or authentication measures;
- interfere with or disrupt the Services, or reverse engineer, decompile, or misuse them except to the extent the law permits;
- use automated means, modified copies of the app, or anything other than a genuine installed copy of Sorted to access the Services.
6. Your content
You own your content. The lists, items, notes, and other material you add to Sorted remain yours. To operate the Services, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your content - solely to provide and improve the Services for you and the people you share with. This license ends when you delete the content or your account, except for content already shared with others and for the backup retention described in the Privacy Policy.
You are responsible for the content you add and for the people you invite. Only invite people who are comfortable receiving your shared lists, and make sure you have the right to share any information you enter.
7. Shared lists and collaboration
When you share a list, its members can view and change that list’s contents, can see your display name and photo, and can see who checked off what. Items checked off on a shared list count toward every member’s buying history and Insights. If you leave a shared list you own, ownership passes to another member so the group keeps its list; a list with no other members is deleted. Treat other members’ contributions with respect - collaboration only works when everyone does.
8. Automated features: categories, icons and recipe ideas
Sorted uses automated systems, including AI models run by third parties, to sort items into categories, draw icons, and suggest recipes from what you have bought. How this works and what is sent is explained in the Privacy Policy.
These features are provided for convenience and are generated automatically. They can be inaccurate, incomplete, or wrong. Categories and icons are suggestions you can change. Recipe ideas are not nutritional, dietary, or medical advice: always check ingredients, quantities and preparation yourself, especially if you or anyone you cook for has allergies or dietary restrictions. We make no warranty about automated results and are not responsible for decisions you make based on them.
10. App updates
We release updates to fix problems, improve security and add features. Old versions eventually stop working with our servers. When that happens the app will ask you to update before you can continue; we aim to give reasonable notice and to keep the number of required updates small.
11. Advertising
The Services do not currently include advertising. If we ever add it, we will update these Terms and the Privacy Policy first and tell you in the app before any ad appears.
12. Third-party services and app stores
The Services rely on third-party platforms, including Google (Firebase and Google Play), Apple (the App Store, Sign in with Apple and push notifications), our hosting provider, and the AI providers named in the Privacy Policy. Your use of those platforms is governed by their terms. Where you download Sorted from an app store, the store’s rules also apply, and the store is not responsible for the Services, for maintenance or support, for any warranty claim, or for any claim that the Services infringe someone’s rights - those are between you and us.
For the iOS app, Apple’s Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
13. Our intellectual property
The Services, including the Sorted name, logo, software, design, and the shared category dictionary, icon library and recipe catalogue that the app builds up, are owned by SkylonTech Inc. and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Services except as the law allows or we permit in writing.
14. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content or automated result will be accurate. You use the Services at your own discretion and risk, to the fullest extent permitted by law.
15. Limitation of liability
To the fullest extent permitted by law, SkylonTech Inc. and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim, or CAD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless SkylonTech Inc. from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or the rights of others.
17. Termination
You may stop using the Services at any time and delete your account from Profile in the app, or by emailing support@skylontech.ca from the address on your account. Deletion is immediate and permanent; what it removes is described in the Privacy Policy. Deleting your account does not cancel a store subscription - cancel that in Google Play or your Apple ID settings.
We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. If we discontinue the Services we will give reasonable notice so you can export your data. Sections that by their nature should survive termination - including content licenses already granted to others, disclaimers, limitation of liability, and indemnification - will survive.
18. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute arising from these Terms or the Services, except where applicable law gives you the right to bring a claim in your local courts. If you are a consumer in the EEA or the UK, nothing in these Terms removes the protections of the mandatory consumer law of the country you live in.
19. Changes to these terms
We may update these Terms from time to time. Each version has a number and an effective date, shown at the top of this page, and earlier versions stay available. If a change affects your rights or obligations, we will tell you in the app and ask you to review and accept the new version before you continue; for minor wording changes we will show you a notice. We keep a record of which version you accepted and when.
